House Committee on Judiciary Non-civil offers the following substitute
to

BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 2 of Chapter 9 of Title 19 of the Official Code of Georgia
Annotated, the "Georgia Child Custody Intrastate Jurisdiction Act of 1978," so
as to change certain provisions relating to actions by physical or legal
custodians not being permitted in certain circumstances; to prohibit other
persons or entities from maintaining certain actions under certain
circumstances; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
2 of Chapter 9 of Title 19 of the Official Code of Georgia Annotated, the
"Georgia Child Custody Intrastate Jurisdiction Act of 1978," is amended by
adding a new subsection (c) to Code Section 19-9-24, relating to actions by
physical or legal custodians not being permitted in certain circumstances, to
read as follows:
"(c)
It may be a defense to an action for contempt for failure to pay court ordered
child support that the recipient of the court ordered child support has
willfully withheld custody or visitation rights in violation of a valid custody
or visitation
order."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
