A BILL TO BE ENTITLED
AN ACT

To amend Chapter 12 of Title 45 of the Official Code of Georgia Annotated, relating to the Governor, so as to establish the position of immigration enforcement director within the Office of Homeland Security; to provide for the appointment and duties of such director; to provide for staff; to provide for the distribution of certain information; to provide for the promulgation of certain rules and regulations; to provide for certain reports; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 12 of Title 45 of the Official Code of Georgia Annotated, relating to the Governor, is amended by adding a new Article 7 to read as follows:

"ARTICLE 7

45-12-221.
There is created within the Office of Homeland Security in the Office of the Governor the position of immigration enforcement director who shall be appointed by the Governor and serve at the pleasure of the Governor.

45-12-222.
The immigration enforcement director shall:
(1) Provide information to all employers in Georgia to enable such employers to comply with all applicable federal and state laws and rules and regulations concerning the employment of aliens;
(2) Promulgate such rules and regulations as appropriate to ensure that all employers in this state are complying with all applicable federal and state laws and rules and regulations concerning the employment of aliens;
(3) Provide information to every agency of this state and political subdivision thereof that provides any state, local, or federal benefit as defined in 8 U.S.C. Section 1611 or 8 U.S.C. Section 1621 to enable compliance with all federal laws concerning public benefits;
(4) Promulgate such rules and regulations as appropriate to ensure that every agency of this state and political subdivision thereof that provides any state, local, or federal benefit as defined in 8 U.S.C. Section 1611 or 8 U.S.C. Section 1621 complies with all federal laws concerning public benefits; and
(5) Recommend to the Governor and General Assembly prior to January 31 of every year any legislative changes necessary to ensure compliance with all federal immigration law.

45-12-223.
Subject to appropriations by the General Assembly, the Governor shall provide the immigration enforcement director with such staff and resources as shall be necessary to carry out the duties of such office."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
