HOUSE SUBSTITUTE TO SENATE BILL 636

A BILL TO BE ENTITLED
AN ACT

To amend Part 1 of Article 8 of Chapter 1 of Title 10 of the Official Code of Georgia Annotated, relating to sale of petroleum products, so as to prohibit the production, offering for sale, or sale of biodiesel fuel for certain purposes unless such fuel meets certain standards; to prohibit certain acts relating to gasoline containing methyl tertiary-butyl ether; to provide effective dates; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 1 of Article 8 of Chapter 1 of Title 10 of the Official Code of Georgia Annotated, relating to sale of petroleum products, is amended by adding a new Code section to read as follows:
"10-1-151.1.
It shall be unlawful for any person to produce, offer for sale, or sell any biodiesel fuel to be used in blending such biodiesel fuel with petroleum diesel fuel to create a blended fuel for subsequent sale for use in diesel engines unless the biodiesel fuel meets the specifications of American Society for Testing and Materials Standard D 6751."

SECTION 2.
Said part is further amended by adding a new Code section to read as follows:
"10-1-151.2.
(a) As used in this Code section, the term 'MTBE' means methyl tertiary-butyl ether.
(b) It shall be unlawful to knowingly manufacture, blend, or store for distribution in this state any gasoline containing MTBE.
(c) It shall be unlawful to knowingly distribute, sell, or expose or offer for sale in this state any gasoline containing more than one-half of 1 percent MTBE by volume.
(d) This Code section shall not prohibit the transport through this state of gasoline containing MTBE for delivery outside this state."

SECTION 3.
This Act shall become effective on July 1, 2006; except that Section 2 of this Act shall become effective on January 1, 2008.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
