Tarver of the 22nd and Smith of the 52nd offered the following
amendment:
Amend
SB 622 by striking line 23 of page 1 and inserting in lieu thereof the
following:
consummation;
provided, however, that this subsection shall apply only if the notice of the
subsequent transaction is given within one year after the date of the canceled
hearing."
By
striking lines 1 and 2 of page 3 and inserting in lieu thereof the
following:
such
documents, agreements, reports, and other papers shall be submitted not later
than 14 days prior to the holding of the public hearing required by Code Section
31-7-406 and shall be available for public inspection at the hospital being
acquired not later than 14 days prior to the holding of such public
hearing.
By
striking lines 5 through 9 of page 3 and inserting in lieu thereof the
following:
(c)
Notice to
the Attorney General shall be accompanied by the payment by either the seller or
lessor, or by the acquiring entity, of a fee in the amount of
$50,000.00.
(d)
The Attorney General shall be authorized to retain financial, economic, health
planning, or other experts or consultants to assist in addressing each of the
criteria set forth in Code Section
31-7-406.
The Attorney
General shall be authorized to retain financial, economic, health planning, or

forth in Code Section 31-7-406. Within 30 days after notice from the Attorney
General, the cost and expense incurred in connection with the retention of such
experts or consultants shall be paid directly to each of such experts and
consultants by the parties to the proposed transaction in such proportionate
amounts as the parties to the proposed transaction may agree or otherwise as
determined by the Attorney General; provided, however, that the parties to the
proposed transaction shall not be required to pay any portion of such cost and
expense that exceeds a total amount of
$60,000.00."
