BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 31 of Title 36 of the Official Code of Georgia Annotated, relating
to incorporation of municipal corporations, so as to provide that no municipal
corporation shall be incorporated which has the same name as an existing
municipal corporation or a name which is confusingly similar to that of an
existing municipal corporation; to provide for certification of compliance; to
provide for an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
31 of Title 36 of the Official Code of Georgia Annotated, relating to
incorporation of municipal corporations, is amended by adding after Code Section
36-31-4 a new Code section to read as follows:
"36-31-4.1.
(a)
No municipal corporation shall be incorporated which has the same name as an
existing municipal corporation or a name which is confusingly similar to that of
an existing municipal corporation.
(b)
The provisions of this Code section shall be part of the minimum standards for
incorporation. The certificate required under Code Section 36-31-5 shall
contain a particular recitation of compliance with this Code
section."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
