A BILL TO BE ENTITLED
AN ACT

To amend an Act reincorporating the City of Doraville in the County of DeKalb, approved October 13, 1971 (Ga. L. 1971, Ex. Sess., p. 2154), as amended, so as to change the corporate limits of the city; to provide for a referendum; to provide for automatic repeal under certain circumstances; to provide for effective dates; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act reincorporating the City of Doraville in the County of DeKalb, approved October 13, 1971 (Ga. L. 1971, Ex. Sess., p. 2154), as amended, is amended by adding at the end of Appendix A a new undesignated paragraph to read as follows:
"The corporate limits of the City of Doraville shall also include the following:
All that tract or parcel of land lying and being in Land Lots 320, 337, 340, 341, 342, and 356 of the 18th Land District and Land Lots 249, 250, 277 and 278 of the 6th Land District of DeKalb County, Georgia, which tracts are more particularly described as follows:
TRACT I
All property in Land Lot 341 of DeKalb Countýs 18th District not presently within the City of Doravillés city limits.

TRACT II
All property in Land Lot 342 of DeKalb Countýs 18th District East of Peachtree Industrial Boulevard not presently within the City of Doravillés city limits.

TRACT III
All property in Land Lot 342 of DeKalb Countýs 18th District East of Tilly Mill Road including its corresponding right-of-way not presently within the City of Doravillés city limits.
TRACT IV
All property in Land Lot 342 of DeKalb Countýs 18th District having frontage on Peachtree Industrial Boulevard, Ridgeway Drive and Van Fleet Circle not presently within the City of Doravillés city limits.

TRACT V
All property South of and including Peachtree Industrial Boulevard, West of the Gwinnett County Line within Land Lots 340 and 356 of DeKalb Countýs 18th District and within Land Lots 249, 250, 277 and 278 of DeKalb Countýs 6th District, less and except the Northern Access Road of Peachtree Industrial Boulevard.

TRACT VI
All property in Land Lot 337 of DeKalb Countýs 18th District not presently within the City of Doravillés city limits.

TRACT VII
All property in Land Lot 320 of DeKalb Countýs 18th District which has frontage on Buford Highway not presently within the City of Doravillés city limits."

SECTION 2.
Unless prohibited by the federal Voting Rights Act of 1965, as amended, the election superintendent of DeKalb County shall call and conduct an election as provided in this section for the purpose of submitting this Act to the electors of DeKalb County who reside in the area proposed to be annexed into the City of Doraville pursuant to Section 1 of this Act for approval or rejection. The election superintendent shall conduct that election on the third Tuesday in March, 2007, and shall issue the call and conduct that election as provided by general law. The superintendent shall cause the date and purpose of the election to be published once a week for two weeks immediately preceding the date thereof in the official organ of DeKalb County. The ballot shall have written or printed thereon the words:
"(  )  YES
(  )  NO
Shall the Act be approved which annexes certain territory into the corporate limits of the City of Doraville?"
All persons desiring to vote for approval of the Act shall vote "Yes," and all persons desiring to vote for rejection of the Act shall vote "No." If more than one-half of the total votes cast on such question are for approval of the Act, it shall become of full force and effect immediately. If the Act is not so approved or if the election is not conducted as provided in this section, the remaining sections of this Act shall not become effective and this Act shall be automatically repealed on the first day of January immediately following that election date. The expense of such election shall be borne by the City of Doraville. It shall be the election superintendent́s duty to certify the result thereof to the Secretary of State.

SECTION 3.
Except as otherwise provided in Section 2 of this Act, this Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
