BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 60 of Title 36 of the Official Code of Georgia Annotated, relating
to general provisions applicable to counties and municipal corporations, so as
to provide that noise related ordinances may not be construed to regulate land
use; to provide for related matters; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
60 of Title 36 of the Official Code of Georgia Annotated, relating to general
provisions applicable to counties and municipal corporations, is amended by
adding a new Code section to the end of such chapter to read as
follows:
∀36-60-24.
No
rules, regulations, statutes, or ordinances relating to noise control, noise
pollution, or noise abatement adopted or enacted by a local unit of government
shall be construed to regulate land
use.∀
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
