BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 8 of Title 7 of the Official Code of Georgia Annotated, relating
to safe use of remote service terminals (ATMs), so as to require the use of
9-1-1 emergency call capability; to provide for related matters; to provide for
an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
8 of Title 7 of the Official Code of Georgia Annotated, relating to safe use of
remote service terminals (ATMs), is amended by adding a new Code section,
immediately following Code Section 7-8-4, relating to notices to remote service
terminal customers of basic safety precautions, to read as follows:
∀7-8-4.1.
(a)
The General Assembly hereby finds that remote service terminal (ATM) withdrawals
made under duress are a peculiar danger to the public generally and to the users
of remote service terminals in particular.
(b)
Where 9-1-1 emergency service is available, a remote service terminal (ATM)
shall contain a dedicated voice telephone line operable by a single switch that
establishes an immediate connection to the available 9-1-1 emergency service.
The switch shall be activated through the use of remote service terminal (ATM)
access device.
(c)
Each remote service terminal (ATM) shall have displayed, in a conspicuous place,
a warning notice that any person who knowingly makes a false alarm or places a
call through the 9-1-1 emergency telephone system without the purpose of
reporting the need for 9-1-1 service shall be subject to criminal prosecution
for an offense which shall be punishable by a fine of $500.00, or imprisonment
for a minimum of no less than six months, or
both.∀
SECTION
2.
This
Act shall become effective on January 1, 2007, and shall be applied to all
transactions conducted on or after that date.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
