A BILL TO BE ENTITLED
AN ACT

To amend Chapter 6 of Title 16 of the Official Code of Georgia Annotated, relating to sexual offenses, so as to provide an enhanced penalty for certain offenses committed upon persons having a mental abnormality; to provide for a definition; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 6 of Title 16 of the Official Code of Georgia Annotated, relating to sexual offenses, is amended by inserting at the end thereof the following:
16-6-25.
If any person is convicted of an offense found in this chapter committed upon a person having a mental abnormality the minimum and maximum periods of incarceration stated for such offense shall be increased by ten years, respectively. As used in this Code section, the term 'mental abnormality' means a congenital or acquired condition of a person that affects the emotional or volitional capacity of the person. This Code section shall apply to any offense committed on or after July 1, 2006.

SECTION 2 .
All laws and parts of laws in conflict with this Act are repealed.
