BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 13 of Chapter 5 of Title 49 of the Official Code of Georgia
Annotated, relating to PeachCare for Kids, so as to provide for the treatment of
delinquent premium payments for PeachCare eligibility; to provide for related
matters; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
13 of Chapter 5 of Title 49 of the Official Code of Georgia Annotated, relating
to PeachCare for Kids, is amended by striking subsection (e) of Code Section
49_5_273, relating to the creation of PeachCare, availability, eligibility,
payment of premiums, and enrollment, and inserting in lieu thereof the
following:
"(e)
The department shall require payment of premiums for participation in the
program. The premiums shall not exceed the amounts permitted under Section
1916(b)(1) of the Social Security Act or federal law.
If the
department receives and accepts from or on behalf of a recipient a premium that
is considered delinquent, the department shall continue to provide health care
benefits for such
recipient."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
