A BILL TO BE ENTITLED
AN ACT

To amend Chapter 1 of Title 50 of the Official Code of Georgia Annotated, relating to general provisions concerning state government, so to provide that no state agency or state officer shall accept or utilize certain grants or funds except under certain conditions; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 1 of Title 50 of the Official Code of Georgia Annotated, relating to general provisions concerning state government, is amended by adding a new Code Section 50-1-8 to read as follows:
"50-1-8.
No state agency or state officer shall accept or utilize grants or funds from any settlement fund created from any settlement on behalf of Georgia citizens for any purpose associated with the performance of the official duties and responsibilities of such agency or officer unless:
(1) Such grants or funds are included within and accounted for in the current budget of such agency or officer passed by the General Assembly and approved by the Governor; or
(2) The agency or officer notifies the General Assembly, on forms prescribed by the General Assembly, of the application for and receipt of such grants or funds, specifies the exact purpose for which such agency or officer intends to utilize such grants or funds, and retains such grants or funds until the next fiscal year prior to utilizing such funds and includes and accounts for such grants or funds in the agency or officer´s budget for the next fiscal year."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
