A BILL TO BE ENTITLED
AN ACT

To amend Article 3 of Chapter 5 of Title 40 of the Official Code of Georgia Annotated, relating to cancellation, suspension, and revocation of driverś licenses, so as to create a youthful driver tracking service that allows parents and guardians to monitor the driving performance of their children who are 18 years of age or younger; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 3 of Chapter 5 of Title 40 of the Official Code of Georgia Annotated, relating to cancellation, suspension, and revocation of driverś licenses, is amended by inserting a new Code section immediately following Code Section 40-5-57.2, relating to suspensions based on failure to pay for gasoline, to read as follows:
"40-5-57.3.
(a) Notwithstanding any other provision of this chapter, if the court finds that a driver who is 18 years of age or younger has committed a violation of any of the provisions listed in subsection (a) of Code Section 40-5-57.1, the court may require the driver and his or her parents or guardians to participate in a registered youthful driver tracking service as described in this Code section.
(b) A 'youthful driver tracking service' is an entity that enables parents or guardians to monitor the driving performance of their children who are 18 years of age or younger. The service may provide tracking by either or both of the following methods:
(1) The posting of a placard on a vehicle that shows a toll-free telephone number and a unique identifying number and also includes a request to members of the public to call the toll-free telephone number to report inappropriate driving practices. The youthful driver tracking service shall enter into a contract with the parents or guardians under which the service promises to timely forward to the parents or guardians all reports of inappropriate driving practices by the youthful driver.
(2) The use of global positioning system enabled wireless telephones or similar technologies. The youthful driver tracking service shall enter into a contract with the parents or guardians under which the service promises to provide the parents with real-time information about the location and speed of movement of the youthful driver or the vehicle in which the youthful driver is traveling.
(c) A youthful driver tracking service shall register with the Department of Motor Vehicle Safety. The registration shall consist of a narrative description of the services offered by the service, together with a listing of the manager in charge of the service, the servicés address, and the servicés telephone number. A fee for registration shall be established by the department. Registration under this subsection remains valid for one year, and it is the responsibility of the youthful driver tracking service to timely file a revised registration statement to reflect any changes in the required information. If the department determines that the service is not providing the services described in the narrative statement, the department may suspend the registration, provided that the department may reinstate the registration when the service files an acceptable statement reflecting its actual practices.
(d) Any rates, rating schedules, or rating manuals for the liability, personal injury protection, and collision coverages of a motor vehicle insurance policy may provide for an appropriate reduction in premium charges if any driver covered under the policy is a youthful driver who is participating in a registered youthful driver tracking service as described in this Code section."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
