BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 4 of Title 17 of the Official Code of Georgia Annotated, relating
to arrest of persons, so as to create provisions relating to arrests under
certain circumstances; to provide for related matters; to repeal conflicting
laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
4 of Title 17 of the Official Code of Georgia Annotated, relating to arrest of
persons, is amended inserting a new Code Section to follow Code Section
17-4-20.1, relating to investigation of family violence, and inserting in lieu
thereof the following:
"17-4-20.2.
Whenever
a law enforcement officer responds to an incident at a residence where a person
under the age of 18 years resides, whether or not such person is present, and an
arrest is made for violation of Code Section 16-5-73, prohibiting a
child́s
presence during the manufacture of methamphetamine, Code Section 16-13-31,
involving trafficking in methamphetamines, or Code Section 16-30-30, involving
possession, manufacture, or possession of methamphetamines with the intent to
distribute, the law enforcement officer shall notify the Division of Family and
Children Services of the Department of Human Resources of such
arrest."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
