A BILL TO BE ENTITLED
AN ACT

To amend an Act providing for the appointment of magistrates in Fulton County, approved March 18, 1983 (Ga. L. 1983, p. 4373), as amended, particularly by an Act approved April 9, 1999 (Ga. L. 1999, p. 3783), so as to change the number of magistrates in Fulton County; to provide the procedure in connection with the appointment of new magistrates and provide for terms of office; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act providing for the appointment of magistrates in Fulton County, approved March 18, 1983 (Ga. L. 1983, p. 4373), as amended, particularly by an Act approved April 9, 1999 (Ga. L. 1999, p. 3783), is amended by striking Section 1 in its entirety and inserting in lieu thereof a new Section 1 to read as follows:

"SECTION 1.
The number of magistrates authorized for the Magistrate Court of Fulton County shall be nine magistrates."

SECTION 2.
Said Act is further amended by striking subsection (a) of Section 2 in its entirety and inserting in lieu thereof a new subsection (a) to read as follows:
"(a) On the effective date of this Act, the eight persons holding office as magistrates of Fulton County shall continue to hold office pursuant to each respective magistratés term of appointment. The one additional magistrate authorized by this Act shall be selected by majority vote of the judges of the State Court of Fulton County for an initial term of office beginning upon the date of appointment by a majority vote of the judges of the State Court of Fulton County and ending on December 31, 2006. Successors to all magistrates shall be selected by a majority of the judges of the State Court of Fulton County for terms as provided by general law."

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
