A BILL TO BE ENTITLED
AN ACT

To amend Code Section 47-2-96.1 of the Official Code of Georgia Annotated, relating to creditable service in the Employeeś Retirement System of Georgia for certain temporary full-time service, so as to change certain provisions relating to allowable service; to provide conditions for an effective date and automatic repeal; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 47-2-96.1 of the Official Code of Georgia Annotated, relating to creditable service in the Employeeś Retirement System of Georgia for certain temporary full-time service, is amended by striking in its entirety subsection (a) and inserting in lieu thereof the following:
"(a) As used in this Code section, 'temporary full-time service' means employment by the legislative branch of the state government prior to January 1, 1996 July 1, 2006, on a full-time basis for less than nine months in any calendar year that did not qualify the employee to be a member of the retirement system."

SECTION 2.
Said Code section is further amended by striking in its entirety subsection (d) and inserting in lieu thereof the following:
"(d) In order to obtain creditable service under this Code section, a member must make application to the board of trustees not later than January 1, 1999 2007."

SECTION 3.
This Act shall become effective on July 1, 2006, only if it is determined to have been concurrently funded as provided in Chapter 20 of Title 47 of the Official Code of Georgia Annotated, the "Public Retirement Systems Standards Law"; otherwise, this Act shall not become effective and shall be automatically repealed in its entirety on July 1, 2006, as required by subsection (a) of Code Section 47-20-50.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
