BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 1 of Title 35 of the Official Code of Georgia Annotated, relating
to general provisions relative to law enforcement officers and agencies, so as
to prohibit the use of electroshock devices by law enforcement officers; to
provide for related matters; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
1 of Title 35 of the Official Code of Georgia Annotated, relating to general
provisions relative to law enforcement officers and agencies, is amended by
inserting at the end of said chapter a new Code Section 35-1-15 to read as
follows:
"35-1-15.
On
and after July 1, 2005, no state, county, or local law enforcement agency shall
authorize or permit the use of any electroshock device, including stun guns,
stun shields, and Tasers, by an officer in the line of duty. Law enforcement
agencies which do not comply with the requirements of this Code section shall be
subject to the withholding of any state funding or state administered federal
funding."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
