BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Subpart 2 of Part 1 of Article 16 of Chapter 2 of Title 20 of the Official
Code of Georgia Annotated, relating to compulsory attendance, so as to repeal a
provision authorizing the Governor to suspend all or any part of said subpart
because of a riot, insurrection, public disorder, disturbance of the peace,
natural calamity, or disaster; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Subpart
2 of Part 1 of Article 16 of Chapter 2 of Title 20 of the Official Code of
Georgia Annotated, relating to compulsory attendance, is amended by striking in
its entirety Code Section 20-2-702, relating to the
Governoŕs
authority to suspend compulsory attendance laws, and inserting in its place a
new Code Section 20-2-702 to read as follows:
"20-2-702.
When,
in the opinion of the Governor, it is necessary because of any riot,
insurrection, public disorder, disturbance of the peace, natural calamity, or
disaster to suspend all or any part of this subpart in order to protect persons
and property, to preserve the health and welfare of the citizens of this state,
or to preserve the general welfare of the state, he may do so by issuing his
proclamation thereon and filing it in the office of the Secretary of State. The
Governor may proclaim such suspension effective over the entire state or in any
portion thereof.
Reserved."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
