BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Part 3 of Article 4 of Chapter 11 of Title 16 of the Official Code of
Georgia Annotated, relating to carrying and possession of firearms, so as to
change certain provisions relating to carrying deadly weapons to or at public
gatherings; to provide an effective date; to repeal conflicting laws; and for
other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Part
3 of Article 4 of Chapter 11 of Title 16 of the Official Code of Georgia
Annotated, relating to carrying and possession of firearms, is amended by
striking subsection (a) of Code Section 16-11-127, relating to carrying deadly
weapons at public gatherings, in its entirety and inserting in lieu thereof the
following:
"(a)
Except as provided in Code Section 16-11-127.1, a person is guilty of a
misdemeanor when he or she carries to or while at a public gathering any
explosive compound, firearm, or knife designed for the purpose of offense and
defense;
provided, however, that the provisions of this subsection shall not apply to a
person who carries a firearm or knife to or while at an eating establishment
that derives at least 50 percent of its total annual gross food and beverage
sales from the sale of prepared meals or food if such person is licensed to
carry a pistol or revolver pursuant to the provisions of Code Section
16-11-129."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
