BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 2 of Chapter 11 of Title 16 of the Official Code of Georgia
Annotated, relating to offenses against public order, so as to provide for the
crime of unlawful conduct during 911 telephone calls; to provide for criminal
penalties; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
2 of Chapter 11 of Title 16 of the Official Code of Georgia Annotated, relating
to offenses against public order, is amended by inserting a new Code section, to
be designated Code Section 16-11-39.2, to read as follows:
"16-11-39.2.
(a)
A person commits the offense of unlawful conduct during a 911 telephone call if
he or she:
(1)
Without provocation, uses obscene and vulgar or profane language with the intent
to intimidate or harass a 911 communication operator;
(2)
Calls 911, whether or not conversation ensues, for the purpose of annoying,
harassing, or molesting a 911 communication operator, or for the purpose of
disrupting emergency telephone service;
(3)
Calls 911 and intentionally fails to hang up or disengage the connection for the
purpose of interfering with or disrupting emergency service; or
(4)
Calls 911 for the purpose of making a false report of a crime.
(b)
Any person who violates subsection (a) of this Code section shall be guilty of a
misdemeanor and, upon conviction thereof, shall be punished by a fine of not
more than $500.00 or 12 months in jail, or
both."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
