BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 12-8-40.2 of the Official Code of Georgia Annotated, relating
to yard trimming disposal restrictions, so as to provide certain exemptions from
such restrictions at certain times and for certain cities, counties, and solid
waste authorities; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 12-8-40.2 of the Official Code of Georgia Annotated, relating to yard
trimming disposal restrictions, is amended by adding a new subsection to read as
follows:
"(d)(1)(A)
For purposes of this paragraph, the board shall establish and maintain rules or
regulations as to crude oil cost adjustments. Such rules shall include the
determination and use of an appropriate index that reflects the effects of
inflation and deflation upon the price of crude oil per barrel. The rules may
use for such purpose the price of oil per barrel as quoted by the index
published by Bloomberg Financial Services or another comparable index, if the
board determines that such index reflects the effects of inflation and deflation
on the price of crude oil.
(B)
The provisions of subsection (a) of this Code section shall not apply whenever
the cost of crude oil adjusted for inflation as determined by the index adopted
by the board pursuant to subparagraph (A) of this paragraph is greater than
$20.14 per barrel in 1992 dollars.
(2)
The provisions of subsection (a) of this Code section shall not apply to any
city or county that is under an air quality nonattainment order by the United
States Environmental Protection Agency;
provided,
however, that nothing in this subsection shall prohibit any city, county, or
solid waste authority that certifies to the division that such city stockpiles
its compost in a compost site for distribution and does not store it in an
inert, construction and demolition, or municipal solid waste landfill from
imposing any of the restrictions in subsection (a) of this Code
section."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
