BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act creating the Board of Commissioners of Oconee County, approved
April 18, 1917 (Ga. L. 1917, p. 384), as amended, particularly by an Act
approved April 17, 1975 (Ga. L. 1975, p. 3105), so as to provide for terms for
the members of the board of commissioners of Oconee County; to provide for
elections; to provide for a referendum; to provide for an effective date; to
repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act creating the Board of Commissioners of Oconee County, approved April 18,
1917 (Ga. L. 1917, p. 384), as amended, particularly by an Act approved April
17, 1975 (Ga. L. 1975, p. 3105), is amended by striking in its entirety Section
2 of such amendatory Act and inserting in lieu thereof the
following:
"(2)
At the election in November, 2008, the members of the Board of Commissioners of
Oconee County shall be elected as provided in this Act. Those members elected
from Posts 1 and 4 shall be elected for terms of four years and until their
successors are duly elected and qualified. Those members elected from Posts 2
and 3 shall be elected for terms of two years and until their successors are
duly elected and qualified. Thereafter, successors shall be elected for terms of
four years. All members shall take office on January 1 of the year following
their
election."
SECTION
2.
The
election superintendent of Oconee County shall cause the question provided in
this section to be placed on the ballots provided to the electors of Oconee
County on the date of the November, 2006, general election. The ballot shall
have written or printed thereon the words:

"( ) YES
( ) NO
|
Shall
that Act be approved which provides that the members of the Board of
Commissioners of Oconee County shall be elected to serve staggered four-year
terms?"

All
persons desiring to vote for approval of the Act shall vote "Yes," and all
persons desiring to vote for rejection of the Act shall vote "No." If more than
one-half of the votes cast on such question are for approval of the Act, Section
1 of this Act shall become of full force and effect on January 1, 2007. If the
Act is not so approved or if the election is not conducted as provided in this
section, Section 1 of this Act shall not become effective and this Act shall be
automatically repealed on the first day of January immediately following that
election date. The expense of such election shall be borne by Oconee County.
It shall be the election
superintendent́s
duty to certify the result thereof to the Secretary of State.
SECTION
3.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
4.
All
laws and parts of laws in conflict with this Act are repealed.
