A BILL TO BE ENTITLED
AN ACT

To amend Chapter 2 of Title 31 of the Official Code of Georgia Annotated, relating to the Department of Human Resources, so as to provide that state grant-in-aid funds shall be allotted to certain participating counties based on population; to provide for construction; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 2 of Title 31 of the Official Code of Georgia Annotated, relating to the Department of Human Resources, is amended by adding a new Code section to the end of such chapter to read as follows:
"31-2-9.
(a) Any state grant-in-aid funds for local public health services which are received by the department through appropriations by the General Assembly for distribution to counties having a population of 70,000 or more according to the United States decennial census of 2000 or any future such census shall be disbursed based solely on the countýs population according to the most recent United States decennial census. No factor other than population and no formula that considers any factor other than population may be used to disburse such funds. This shall include grant-in-aid funds appropriated through a specific line item as well as grant-in-aid funds included as a component in specific program funds in an appropriations Act.
(b) In the event that the department disburses grant-in-aid funds pursuant to contracts entered into with counties which come under subsection (a) of this Code section, and such a contract or contracts are in effect on the effective date of this Code section, this Code section shall apply to that county or counties upon the expiration or termination of the applicable contract; provided, however, that the department shall not be authorized to extend or renew any such contract or contracts. This Code section shall not be construed to impair the rights of a party pursuant to a contract."
SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
