A
BILL TO BE ENTITLED
AN
ACT
To
amend Part 1 of Article 1 of Chapter 3 of Title 27 of the Official Code of
Georgia Annotated, relating to general provisions relative to wildlife, so as to
change certain provisions relating to the unlawful enticement of game; to
provide legislative findings and declarations; to repeal conflicting laws; and
for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
The
General Assembly finds and declares that this Act is enacted pursuant to Article
III, Section VI, Paragraph II(a)(1) of the Constitution.
SECTION
2.
Part
1 of Article 1 of Chapter 3 of Title 27 of the Official Code of Georgia
Annotated, relating to general provisions relative to wildlife, is amended by
striking subsection (a) of Code Section 27-3-9, relating to the unlawful
enticement of game, and inserting in lieu there thereof the
following:
∀(a)
It shall be unlawful for any person to place, expose, deposit, distribute, or
scatter any corn, wheat, or other grains, salts, apples, or other feeds or bait
so as to constitute a lure or attraction or enticement for any game bird or game
animal on or over any area where hunters are or will be hunting; provided,
however, that
is:
(1)
The prohibition of this subsection shall not apply and
it shall be lawful to hunt deer within the
vicinity of such feeds if the hunter is at least 200 yards away from and not
within sight of the feed or bait
in those
counties for which a deer season is established north of those counties
specified in paragraph (2) of this subsection; and
(2)
The prohibition of this subsection shall not apply and it shall be lawful to
hunt deer within any vicinity of such feeds in a feeder for deer on private
lands in those counties for which a deer season is established south of and
including Heard, Troup, Meriwether, Pike, Lamar, Monroe, Jones, Baldwin,
Washington, Glascock, Jefferson, and Burke counties, provided that any such
feeder must be refilled completely with feed not less than once every two weeks
throughout each calendar year in which such feeder is
used.∀
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
