A BILL TO BE ENTITLED
AN ACT

To amend an Act entitled "An Act to provide for members of the board of the hospital authority of Clarke County," approved April 6, 1982 (Ga. L. 1982, p. 3705), so as to provide for staggered six-year terms for the members of such authority board; to provide for current membership; to provide for nominations for appointments; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act entitled "An Act to provide for members of the board of the hospital authority of Clarke County," approved April 6, 1982 (Ga. L. 1982, p. 3705), is amended by striking in its entirety Section 1 and inserting in lieu thereof the following:
SECTION 1.
(a) The board of the hospital authority of Athens-Clarke County shall consist of nine members appointed to serve six-year terms. A member whose term expires shall not be eligible for reappointment until a period of one year has elapsed; provided, however, that a member who was appointed to fill an unexpired term shall be eligible for reappointment for a full six-year term.
(b) Board members shall serve staggered terms so that three members are appointed every two years. The terms of the following current members of the board shall expire on February 28, 2007: Carl R. Nichols, Helen Mills, and James E. Fair. The terms of the following current members of the board shall expire on February 28, 2009: Asa T. Boynton, Marilyn W. Farmer, and J. William Douglas. The terms of the following current members or the board shall expire on February 28, 2011: William O. Britt IV, Robert D. Sinyard, and Arthur Dallas Spurlock.

(c) All terms shall begin on March 1 of the year of appointment and shall end on February 28 of the sixth year of the term. In the event of a vacancy, the remaining members of the board shall submit nominations for appointment to the Athens-Clarke County Board of Commissioners within 60 days of the vacancy.
(d) The members of the board shall submit nominations for appointment of new members to replace members whose terms are about to expire to the Athens-Clarke County Board of Commissioners not later than 60 days prior to the expiration of terms of office.
(e) Members of the authority shall be residents of Athens-Clarke County.

SECTION 2.
Said Act is further amended by striking in its entirety Section 2 and inserting in lieu thereof the following:
SECTION 2.
This Act is enacted pursuant to the authority of O.C.G.A. subsection (c) of Section 31-7-72, relating to boards of hospital authorities in existence prior to March 15, 1964.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
