A BILL TO BE ENTITLED
AN ACT

To amend Article 2 of Chapter 6 of Title 32 of the Official Code of Georgia Annotated, relating to dimensions and weight of vehicles and loads, so as to prohibit stopping vehicles hauling live poultry when the temperature and humidity could cause the live poultry to expire; to provide for exceptions; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 2 of Chapter 6 of Title 32 of the Official Code of Georgia Annotated, relating to dimensions and weight of vehicles and loads, is amended by adding a new Code Section 32-6-30.1 immediately following Code Section 32-6-30, relating to stopping vehicles for purposes of weighing, measuring, or inspecting, to read as follows:
32-6-30.1.
(a) Law enforcement officers or employees of the Department of Public Safety are prohibited from stopping any truck that is hauling live poultry upon a public road of this state when the temperature is above 85 degrees Fahrenheit and the humidity is above 50 percent.
(b) If criminal activity is suspected, law enforcement officers or employees of the Department of Public Safety may make an investigatory stop of any truck that is hauling live poultry. An investigatory stop shall be limited to ten minutes unless an arrest has been made.

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
