A BILL TO BE ENTITLED
AN ACT

To amend Article 5 of Chapter 4 of Title 26 of the Official Code of Georgia Annotated, relating to prescription drugs, so as to prohibit the requirement of prior authorization or other restrictions on medications prescribed for certain treatments and for critical or life-threatening medical conditions for patients enrolled in Medicaid or any state funded health care program; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 5 of Chapter 4 of Title 26 of the Official Code of Georgia Annotated, relating to prescription drugs, is amended by adding at its end a new Code section to read as follows:
26-4-91.
No requirement for prior authorization or other restrictions may be imposed under Medicaid or any state funded health care program on medications prescribed for patients for immunosuppressive treatment of transplantation or oncology treatment or for the treatment of critical or life-threatening diseases, including but not limited to serious mental health diseases including schizophrenia, bipolar disorders, attention deficit disorder, attention deficit hyperactivity disorder, and major depressive disorders as defined by the edition of the Diagnostics and Statistical Manual of Mental Disorders of the American Psychiatric Association in effect on July 1, 2006; insulin-dependent diabetes; HIV/acquired immune deficiency syndrome; epilepsy; hepatitis; eye sight threatening conditions such as glaucoma; asthma or cardio obstructive pulmonary disease; hemophilia; and Crohńs disease/ulcerative colitis.

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
