A BILL TO BE ENTITLED
AN ACT

To amend Article 1 of Chapter 36 of Title 36 of the Official Code of Georgia Annotated, relating to general provisions relative to the annexation of territory, so as to provide that a municipal corporation may not annex property located in a county in which less than 10 percent of such municipality lies without the consent of the county governing authority; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 1 of Chapter 36 of Title 36 of the Official Code of Georgia Annotated, relating to general provisions relative to the annexation of territory, is amended by inserting at the end thereof a new Code section to read as follows:
36-36-12.
Any other provision of this chapter to the contrary notwithstanding, a municipal corporation may not annex to the existing corporate limits of such municipality, by any method authorized pursuant to this chapter, any unincorporated area located in a county in which less than 10 percent of the area included within the existing corporate limits of such municipality lies without the consent of the county governing authority.

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
