BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating
to elementary and secondary education, so as to provide for accurate and
complete electronic format versions of certain textbooks; to provide for
supplying copies of electronic text versions of certain textbooks to local
boards of education upon request; to authorize local boards of education to
provide electronic versions of textbooks to schools and students; to provide for
payment; to provide for construction; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
2 of Title 20 of the Official Code of Georgia Annotated, relating to elementary
and secondary education, is amended by striking Code Section 20-2-1015, relating
to electronic format versions of textbooks recommended by the State Board of
Education, and inserting in lieu thereof the following:
"20-2-1015.
The
publisher of a textbook recommended by the State Board of Education shall
provide an electronic format version of such
textbook.
For each
textbook or new edition of a textbook recommended by the State Board of
Education after July 1, 2005, the publisher shall make available an accurate and
complete electronic version of such textbook. Upon request from any local board
of education, the State Board of Education shall provide a copy of such an
electronic format version to such local board of education. Local boards of
education are authorized to provide electronic format versions of textbooks to
local schools and students. This Code section shall not be construed to
authorize the State Board of Education or any local board of education to
infringe the copyright or other intellectual property rights for any textbook.
The local board of education shall decide whether to pay for the cost of the
electronic textbook or to require the student or parent to pay for the cost of
the electronic
textbook."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
