BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Part 3 of Article 4 of Chapter 11 of Title 16 of the Official Code of
Georgia Annotated, relating to carrying and possession of firearms, so as to
provide that part-time municipal and city court judges shall be treated as
full-time judges for purposes of being exempt from certain state weapons
requirements so that part-time judges shall be exempt in the same manner as
full-time judges; to change certain provisions relating to carrying deadly
weapons to or at public gatherings; to provide for constables to carry pistols
in publicly owned or operated buildings; to exempt constables from the
prohibition of carrying weapons within school safety zones, at school
functions, or on school property while in the performance of their official
duties; to provide for related matters; to provide an effective date; to repeal
conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Part
3 of Article 4 of Chapter 11 of Title 16 of the Official Code of Georgia
Annotated, relating to carrying and possession of firearms, is amended by
striking paragraph (12) of subsection (a) of Code Section 16-11-130, relating to
exemptions from Code Sections 16-11-126 through 16-11-128, and inserting in its
place a new paragraph (12) to read as follows:
"(12)
State and federal trial and appellate judges, full-time
and permanent
part-time judges of municipal and city
courts, and former state trial and appellate judges retired from their
respective offices under state
retirement;"
SECTION
2.
Said
part is further amended by striking subsection (c) of Code Section 16-11-127,
relating to carrying deadly weapons at public gatherings, and inserting in lieu
thereof the following:
"(c)(1)
This Code section shall not apply to competitors participating in organized
sport shooting events.
(2)
Law enforcement officers, peace officers retired from state or federal law
enforcement agencies, judges, magistrates,
constables,
solicitors-general, and district attorneys may carry pistols in publicly owned
or operated
buildings."
SECTION
3.
Said
part is further amended in paragraph (5) of subsection (c) of Code Section
16-11-127.1, relating to carrying weapons within school safety zones, at school
functions, or on school property, by striking "and" at the end of subparagraph
(E) and inserting "and" after the ";" in subparagraph (F) and adding a new
subparagraph (G) to read as follows:
"(G)
Constables of any county of this
state."
SECTION
4.
This
Act shall become effective on July 1, 2006.
SECTION
5.
All
laws and parts of laws in conflict with this Act are repealed.
