The House Committee on Governmental Affairs offers the following substitute to
SR 804:

A RESOLUTION

To create the North Fulton Boundary Commission; and for other purposes.

WHEREAS, the area of North Fulton County is populated by three municipalities: Alpharetta, Roswell, and Mountain Park, and two additional municipalities, Milton and Johns Creek, have been proposed; and

WHEREAS, there has been a significant amount of discussion concerning the appropriate boundaries for such municipalities; and

WHEREAS, it is the intent of the General Assembly to permit the local jurisdictions to resolve these issues among themselves, if possible; and

WHEREAS, the General Assembly believes that the establishment of a commission composed of representatives of each of the affected municipalities would be the best vehicle for achieving a resolution of these issues.

NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA that there is created the North Fulton Boundary Commission to be composed of one representative each selected by the governing authority of the City of Alpharetta, the City of Mountain Park, and the City of Roswell and, if authorized in the 2006 session of the General Assembly, the City of Milton and the City of Johns Creek. The chairperson and vice chairperson of the commission shall be elected from among the members of the commission by the members of the commission.

BE IT FURTHER RESOLVED that, upon all members of the commission being appointed, the commission shall undertake a study of the boundaries of such municipalities taking into account the conditions, needs, issues, and problems related thereto including the natural boundaries, communities of interest, service delivery, and the preferences of the residents affected and shall prepare a report recommending any changes which the commission deems necessary or appropriate. The commission may conduct such meetings at such places and at such times as it may deem necessary or convenient to enable it to exercise fully and effectively its powers, perform its duties, and accomplish the objectives and purposes of this resolution. The members of the commission shall not receive any compensation for attending the meetings of the commission. Upon unanimous agreement by the members of the commission, the commission shall make a report of its findings and recommendations, with suggestions for proposed legislation, if any, on or before February 1, 2007. The commission shall stand abolished on February 1, 2007.
