A BILL TO BE ENTITLED
AN ACT

To amend Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, the "Georgia Medical Assistance Act of 1977," so as to provide that the Department of Community Health shall establish a comprehensive program to monitor for and detect the provision of medical assistance benefits to ineligible individuals; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, the "Georgia Medical Assistance Act of 1977," is amended by inserting after Code Section 49-4-143 a new Code section to read as follows:
"49-4-143.1.
(a) During calendar year 2006, the Department of Community Health shall establish a comprehensive program to monitor for and detect the provision of medical assistance benefits to ineligible individuals. This program shall include financial audits, performance audits, and such other measures as deemed appropriate by the department to meet the goal of monitoring for and detecting the provision of benefits to ineligible individuals for the purposes of minimizing improper and unnecessary expenditures of public funds.
(b) Not later than December 31, 2006, the department shall provide to the Governor and the General Assembly a report of the goals, implementation, and performance of the program established pursuant to this Code section."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
