BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act creating a new charter for the City of Chamblee, approved March 28,
1935 (Ga. L. 1935, p. 976), as amended, so as to change the corporate boundaries
of such city; to provide for a referendum; to provide for automatic repeal under
certain circumstances; to provide for effective dates; to repeal conflicting
laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act creating a new charter for the City of Chamblee, approved March 28, 1935
(Ga. L. 1935, p. 976), as amended, is amended by adding a new Section 2.1 to
read as follows:
"SECTION
2.1.
In
addition to the territory included within the existing corporate boundaries of
the City of Chamblee pursuant to previous acts of the General Assembly of the
State of Georgia, the following described territory shall also be included
within the corporate boundaries of the City of Chamblee:
PARCEL
ONE
Beginning
on the southeastern right of way of Peachtree Road at the point where the
present northeastern corporate limit line intersects the southeastern right of
way of Peachtree Road, and running thence easterly and northerly along the
eastern right of way line of Peachtree Road to the intersection of the eastern
right of way line of Peachtree Road and the southerly right of way line of
Peachtree Industrial Boulevard; and continuing along said southerly right of way
line of Peachtree Industrial Boulevard to the point where the southerly right of
way line of Peachtree Industrial Boulevard intersects a line constituted of the
east boundary line of Land Lot 323 and the east boundary line of Land Lot 334,
18th District; running thence in a northerly direction along a line constituted
of the east boundary line of Land Lot 323 and the east boundary line of Land Lot
334 to a point where the east boundary line of Land Lot 334 intersects the
southerly right of way line of Interstate Highway 285; running thence in a
northwesterly and westerly direction along the southern right of way line of
Interstate Highway 285 to a point where the southern right of way line of
Interstate Highway 285 intersects the western right of way line of
Chamblee-Dunwoody Road; running thence southerly along the western right of way
line of Chamblee-Dunwoody Road to a point where said right of way line would
intersect the northern right of way line of Harts Mill Road, if the northern
right of way line of Harts Mill Road was extended; thence easterly across
Chamblee-Dunwoody Road and easterly, southeasterly and southerly along the
present northern and eastern corporate limit line of the City of Chamblee to the
southeaster right of way of Peachtree Road and the point of beginning.
PARCEL
TWO
Beginning
at the point where the northern right of way line of Harts Mill Road intersects
the western line of Land Lot 307 of the 18th District, running thence westerly
along the northern right of way line of Harts Mill Road to the point where the
northern right of way line of Harts Mill Road would intersect the western right
of way line of Ashford-Dunwoody Road, if the northern right of way line of Harts
Mill Road was extended; thence southerly and southeasterly along the western
right of way line of Ashford-Dunwoody Road to a point where the western right of
way line of Ashford-Dunwoody Road would intersect the southern right of way line
of Peachtree Road, if the western right of way line of Ashford-Dunwoody Road was
extended; running thence northeasterly along the southern right of way line of
Peachtree Road to that point on the southern right of way line of Peachtree Road
which is at present the westernmost corporate limit line; thence northeasterly
across Peachtree Road along the present western corporate limit line to the
point where the west line of Land Lot 278 of the 18th District of DeKalb County
intersects the northwestern right of way line of Peachtree Road, thence
northerly along the west line of Land Lot 278 of the said 18th District;
continuing northerly along the west line of Land Lot 300 of said 18th District,
and continuing northerly along the west line of Land Lot 307 to the point where
the west line of Land Lot 307 intersects the northern right of way line of Harts
Mill Road and the point of
beginning."
SECTION
2.
Unless
prohibited by the federal Voting Rights Act of 1965, as amended, the election
superintendent of DeKalb County shall call and conduct an election as provided
in this section for the purpose of submitting this Act to the electors of DeKalb
County who reside in the area proposed to be annexed into the City of Chamblee
pursuant to Section 1 of this Act for approval or rejection. The election
superintendent shall conduct that election on the third Tuesday in March, 2007,
and shall issue the call and conduct that election as provided by general law.
The superintendent shall cause the date and purpose of the election to be
published once a week for two weeks immediately preceding the date thereof in
the official organ of DeKalb County. The ballot shall have written or printed
thereon the words:

( ) NO

Shall
the Act be approved which annexes certain territory into the corporate limits of
the City of Chamblee?"

All
persons desiring to vote for approval of the Act shall vote "Yes," and all
persons desiring to vote for rejection of the Act shall vote "No." If more than
one-half of the total votes cast on such question are for approval of the Act,
it shall become of full force and effect immediately. If the Act is not so
approved or if the election is not conducted as provided in this section, the
remaining sections of this Act shall not become effective and this Act shall be
automatically repealed on the first day of January immediately following that
election date. The expense of such election shall be borne by the City of
Chamblee. It shall be the election
superintendent́s
duty to certify the result thereof to the Secretary of State.
SECTION
3.
Except
as otherwise provided in Section 2 of this Act, this Act shall become effective
upon its approval by the Governor or upon its becoming law without such
approval.
SECTION
4.
All
laws and parts of laws in conflict with this Act are repealed.
