To
amend Chapter 2 of Title 46 of the Official Code of Georgia Annotated, relating
to the Public Service Commission, so as to provide for superior court filing of
certain commission orders; to provide for venue, judgment, and effect of
judgment; to repeal conflicting laws, and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
2 of Title 46 of the Official Code of Georgia Annotated, relating to the Public
Service Commission, is amended in Code Section 46-2-91, relating to penalties
imposed by order of the commission, by inserting a new subsection to be
designated subsection (d) to read as follows:
"(d)
The commission may file in the superior court in the county in which the person
under order resides or in the county in which the violation occurred or, if the
person is a corporation, in the county in which the corporation maintains its
principal place of business a certified copy of a final order of the commission
unappealed or of a final order of the commission affirmed upon appeal, whereupon
the court shall render judgment in accordance therewith and notify the parties.
The judgment shall have the same effect, and all proceedings in relation thereto
shall thereafter be the same, as though the judgment had been rendered in an
action duly heard and determined by the
court."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
