BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 1 of Title 36 of the Official Code of Georgia Annotated, relating
to general provisions relative to counties, so as to require the governing
authority of each county to provide an acceptable location for the disposal of
septic tank waste; to authorize a county to enter into agreements to dispose of
septic tank waste in lieu of providing a location for such disposal within the
county; to authorize land application of certain septic tank waste; to repeal
conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
1 of Title 36 of the Official Code of Georgia Annotated, relating to general
provisions relative to counties, is amended by adding a new Code section to read
as follows:
"36-1-16.1.
The
governing authority of each county shall provide an acceptable site or location
within that county for the disposal of septic tank waste which has been
collected within that county or by a septic tank pumping and hauling business
located within that county that does not receive waste from multiple sources.
In lieu of providing such site or location, a county may:
(1)
Establish a written agreement with another county, a municipal corporation, or a
private company to accept the septic tank waste which has been collected within
such county;
(2)
Establish a written agreement with another county, a municipal corporation, or a
private company to allow the disposal of septic tank waste at a separate septic
handling facility which meets all federal regulations including 40 CFR Part 503;
or
(3)
Allow land application by septic tank pumping and hauling businesses located
within that county and not receiving waste from multiple sources in accordance
with rules and regulations promulgated pursuant to Code Section
31-2-8."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
