A BILL TO BE ENTITLED
AN ACT

To amend Chapter 6 of Title 19 of the Official Code of Georgia Annotated, relating to alimony and child support, so as to provide for a sentence of imprisonment for contempt of court for failure to comply with court ordered child support or untimely compliance in certain circumstances; to repeal conflicting law; and for other purpose.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 6 of Title 19 of the Official Code of Georgia Annotated, relating to alimony and child support, is amended by adding a new Code section to be designated Code Section 19-6-36 to read as follows:
"19-6-36.
A court of competent jurisdiction shall sentence a noncustodial parent to imprisonment for not less than three days upon finding the noncustodial parent in contempt of court if:
(1) Within a 12 month period, the noncustodial parent has failed or refused to comply with the order for child support three or more times, or has been more than 30 days late in complying with the order for child support three or more times; and
(2) There is no pending request for modification of the order for child support on the grounds of the noncustodial parent́s inability to comply, and the court finds that the noncustodial parent is financially able to comply with the order for support."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
