The House Committee on Public Utilities and Telecommunications offers the
following substitute to HB 738:

A BILL TO BE ENTITLED
AN ACT

To amend Code Section 46-5-139 of the Official Code of Georgia Annotated, relating to the Joint Study Committee on Wireless Enhanced 9-1-1 Charges, so as to reconstitute the Joint Study Committee on Wireless Enhanced 9-1-1 Charges; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 46-5-139 of the Official Code of Georgia Annotated, relating to the Joint Study Committee on Wireless Enhanced 9-1-1 Charges, is amended by striking the Code section in its entirety, and inserting in lieu thereof the following:
"46-5-139.
Reserved.
Following the conclusion of the 2006 session of the General Assembly, the President of the Senate and the Speaker of the House of Representatives shall each appoint no fewer than three members of their respective bodies to serve as members of the Joint Study Committee on Wireless Enhanced 9-1-1 Charges. The chairpersons of the House Committee on Public Utilities and Telecommunications and the Senate Regulated Industries and Utilities Committee shall cochair the study committee. In addition, the Governor shall appoint five members representing the telecommunications industry. The committee shall review the current method of collecting 9-1-1 fees and shall investigate alternative methods of assessing and collecting fees equitably and equally. Such joint study committee shall make any recommendations it considers appropriate to the General Assembly no later than December 31, 2006. The General Assembly may implement the provisions of this Code section by appropriate resolution."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
