A BILL TO BE ENTITLED
AN ACT

To amend Article 3 of Chapter 23 of Title 47 of the Official Code of Georgia Annotated, relating to membership in the Georgia Judicial Retirement System, so as to provide that any person who was serving as a juvenile court judge on July 1, 2006, and who was not a member of any state or local retirement system or pension fund may become a member of the Georgia Judicial Retirement System; to provide that any such person may obtain up to five years of creditable service upon payment of the full actuarial cost; to provide for related matters; to provide conditions for an effective date and automatic repeal; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 3 of Chapter 23 of Title 47 of the Official Code of Georgia Annotated, relating to membership in the Georgia Judicial Retirement System, is amended by inserting at the end thereof the following:
"47-23-51.
(a) Any person who on July 1, 2006, was serving as a juvenile court judge and who was not a member of any state or local retirement system or pension fund may make an irrevocable election to become a member of this system. Such election must be made in writing to the board of trustees not later than December 31, 2006.
(b) Any member who becomes a member under the provisions of subsection (a) of this Code section may obtain up to five years of creditable service for prior service as a juvenile court judge by paying to the board of trustees such amount as determined by the actuary as necessary to grant such creditable service without creating any actuarial accrued liability as to the retirement system. No service may be used for purposes of this subsection which may also be used for credit in any other public retirement system or pension fund."

SECTION 2.
This Act shall become effective on July 1, 2006, only if it is determined to have been concurrently funded as provided in Chapter 20 of Title 47 of the Official Code of Georgia Annotated, the "Public Retirement Systems Standards Law"; otherwise, this Act shall not become effective and shall be automatically repealed in its entirety on July 1, 2006, as required by subsection (a) of Code Section 47-20-50.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
