BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 12 of Title 43 of the Official Code of Georgia Annotated, relating
to disabled veterans and blind persons engaging in peddling, operating
businesses, or practicing professions, so as to clarify the right of certain
disabled veterans and blind persons to vend on the public streets, roadways, and
highways of this state or any county or municipality thereof; to provide for an
exemption from certain management regulations and fees; to repeal conflicting
laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
12 of Title 43 of the Official Code of Georgia Annotated, relating to disabled
veterans and blind persons engaging in peddling, operating businesses, or
practicing professions, is amended by striking Code Section 43-12-1, relating to
exemptions from payment of occupation taxes, administrative fees, or regulatory
fees, and inserting in its place the following:
"43-12-1.
(a)
Subject to the limitations provided in this chapter, the following classes of
persons may peddle,
vend on the
public streets, roadways, and highways of this state or any county or
municipality thereof, conduct business, or
practice the professions and semiprofessions in any county or municipality in
this state without paying an occupation tax, administrative fee, or regulatory
fee for the privilege of so doing, provided such person receives a certificate
of exemption issued by the commissioner of veterans service:
(1)
Any disabled veteran of any war or armed conflict in which any branch of the
armed forces of the United States engaged, whether under United States command
or otherwise;
(2)
Any blind person; or
(3)
Any veteran of peace-time service in the United States armed forces who has a
physical disability incurred during the period of such service.
(b)
Any person who holds a certificate of exemption issued pursuant to subsection
(a) of this Code section shall be exempt from any and all management regulations
and fees designed or intended to regulate or restrict vending on the public
streets, roadways, and highways of this state or any county or municipality
thereof and issued pursuant to the police power of the state, county, or
municipality, whether imposed directly by the state, county, or municipality or
by any entity acting on behalf of such
government."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
