The House Committee on State Institutions and Property offers the following substitute to HB 667:

A BILL TO BE ENTITLED
AN ACT

To amend Article 2 of Chapter 5 of Title 42 of the Official Code of Georgia Annotated, relating to wardens, superintendents, and other personnel of state and county correctional institutions, so as prohibit new contracts for supplies for commissaries for inmates in state correctional institutions before a specified date; to authorize renewal or renegotiation of existing contracts that expire before the specified date; to provide for an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 2 of Chapter 5 of Title 42 of the Official Code of Georgia Annotated, relating to wardens, superintendents, and other personnel of state and county correctional institutions, is amended by inserting a new Code section to be designated Code Section 42-5-41 to read as follows:
"42-5-41.
Wardens of state correctional institutions and other employees and officials of the department are not authorized to enter into any new contracts for supplies for any commissary for inmates in any state correctional institution before July 1, 2006. Such employees and officials are authorized to renew or renegotiate contracts that are in existence on the effective date of this Code section and that expire before July 1, 2006, but such renewed or renegotiated contracts shall expire on July 1, 2006."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
