A BILL TO BE ENTITLED
AN ACT

To amend Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, known as the "Georgia Medical Assistance Act of 1977," so as to require that immunosuppressives for the treatment of transplantation be included in any approved formulary and covered for patients enrolled in Medicaid or any state funded health care program; to prohibit prior authorization requirements or other restrictions under Medicaid or any state funded health care program on immunosuppressives prescribed for transplant patients; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, known as the "Georgia Medical Assistance Act of 1977," is amended by adding a new Code Section 49-4-146.4 to read as follows:
"49-4-146.4.
(a) Immunosuppressives which are approved by the federal Food and Drug Administration for the treatment of transplantation shall be included in any approved formulary and covered for patients enrolled in Medicaid or any state funded health care program.
(b) No requirement for prior authorization or other restrictions may be imposed under Medicaid or any state funded health care program on medications prescribed for patients for the treatment of transplantation for immunosuppressives which are approved by the federal Food and Drug Administration."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
