BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 36-32-40 of the Official Code of Georgia Annotated, relating
to the creation of the Council of Municipal Court Judges of Georgia, membership
and organization, purpose, expenses, contracts, assistance to council, and
members not ineligible to hold office of judge, so as to provide that in the
event of a vacancy in any elective office on the council or a vacancy in a
membership position on the Georgia Municipal Courts Training Council appointed
by the council, the executive committee shall appoint a successor to serve the
remainder of the unexpired term; to provide an effective date; to repeal
conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 36-32-40 of the Official Code of Georgia Annotated, relating to the
creation of the Council of Municipal Court Judges of Georgia, membership and
organization, purpose, expenses, contracts, assistance to council, and members
not ineligible to hold office of judge, is amended by striking subsection (a)
and inserting in lieu thereof the following:
"(a)
There is created a council of municipal court judges to be known as the 'Council
of Municipal Court Judges of Georgia.' The council shall be composed of the
judges of the municipal courts of this state. The council is authorized to
organize itself and to develop a constitution and bylaws. The officers of said
council shall consist of a president, a first vice president, a second vice
president, a secretary, a treasurer, and such other officers as the council
shall deem necessary. The council shall have an executive committee composed of
two representatives from each judicial administrative district.
In the event
of a vacancy in any elective office on the council or in the vacancy in a
membership position on the Georgia Municipal Courts Training Council appointed
by the council, the executive committee shall appoint a successor to serve the
remainder of the unexpired
term."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
