The
House Committee on Education offers the following substitute to HB
462:
A
BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 20-2-55 of the Official Code of Georgia Annotated, relating
to per diem and expenses of local board of education members, so as to provide
that the General Assembly may by local law provide that a local board of
education which provides its members health insurance through the state health
benefit plan shall reimburse a member of such board who is a participant in such
plan as a retired member of a public retirement system for any additional
premium he or she must pay by virtue of his or her membership on the board; to
provide an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 20-2-55 of the Official Code of Georgia Annotated, relating to per diem
and expenses of local board of education members, is amended by inserting at the
end of subsection (b) a new paragraph to read as follows:
"(4)
If a board member is already a member of a health insurance plan established by
Article 1 of Chapter 18 of Title 45 as a retired employee and the result of the
board of
educatiońs
decision to allow its members to participate is to establish dual eligibility
for a member and thus to increase the cost to such member of the state insurance
plan, then the General Assembly by local law may require the local board to pay
any additional cost imposed on such member as a result of his or her membership
on the
board."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
