A BILL TO BE ENTITLED
AN ACT

To amend Subpart 2 of Part 2 of Article 16 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to public school disciplinary tribunals, so as to change certain provisions relating to disciplinary policies for students committing acts of physical violence against teachers, school bus drivers, or other school officials or employees; to provide that teachers who are the victims of certain acts committed by students shall not be required to teach such students without the teacherś consent; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Subpart 2 of Part 2 of Article 16 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to public school disciplinary tribunals, is amended in subsection (c) of Code Section 20-2-751.6, relating to disciplinary policies for students committing acts of physical violence against teachers, school bus drivers, or other school officials or employees, by adding a new paragraph to read as follows:
"(4) Any student who is found by a disciplinary hearing officer, panel, or tribunal to have committed against a teacher during school hours or at a school related function any act of physical violence as defined in paragraph (1) of subsection (a) of this Code section or verbal or physical assault or otherwise made a threat of violence against a teacher and who is not otherwise under expulsion, long-term suspension, or short-term suspension shall not remain or be enrolled in or assigned to any class taught by such victim teacher without the teacheŕs express written consent to the school principal; and any consent so given may be withdrawn subsequently in writing by the teacher at any time. No action shall be taken by a local school system against any teacher for his or her refusal or failure to give such consent or for withdrawing such consent. This paragraph shall apply to any class taught on or after the effective date of this paragraph."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
