BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 4 of Chapter 3 of Title 47 of the Official Code of Georgia
Annotated, relating to membership in the Teachers Retirement System of Georgia,
so as to repeal a provision relating to the eligibility of public school
teachers and employees who are covered by a local retirement fund and who accept
employment with nonsectarian schools; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
4 of Chapter 3 of Title 47 of the Official Code of Georgia Annotated, relating
to membership in the Teachers Retirement System of Georgia, is amended by
striking Code Section 47-3-64, relating to the eligibility of public school
teachers and employees who are covered by a local retirement fund and who accept
employment with private nonsectarian schools, and inserting in its place a new
Code Section 47-3-64 to read as follows:
"47-3-64.
Any
teacher or school employee who is employed in a public school, who is covered by
laws relating to a retirement fund or pension system maintained by any county,
city, or independent school district in this state or the board of education
thereof, and who accepts employment in a nonsectarian private school in this
state attended by students who are eligible for grants from the state shall
continue to be subject to such retirement fund or pension system and shall be
entitled to all of its benefits, provided that he makes or causes to be made to
such retirement fund or pension system the contributions required of and for the
benefit of such teacher or school employee had he continued employment in the
public schools.
Reserved."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
