A BILL TO BE ENTITLED
AN ACT

To amend Code Section 16-13-30.3 of the Official Code of Georgia Annotated, relating to possession of substances containing ephedrine, pseudoephedrine, and phenylpropanolamine, so as to provide for limitations and restrictions regarding certain pseudoephedrine sales; to provide for conditions and requirements applicable to such sales; to provide for exceptions; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 16-13-30.3 of the Official Code of Georgia Annotated, relating to possession of substances containing ephedrine, pseudoephedrine, and phenylpropanolamine, is amended by adding a new subsection immediately following subsection (b), to be designated subsection (b.1), to read as follows:
"(b.1)(1) Products, compounds, mixtures, or preparations containing any detectable quantity of pseudoephedrine, its salts or optical isomers, or salts of optical isomers shall be dispensed only by a licensed pharmacist or a pharmacy technician working under the supervision of a licensed pharmacist.
(2) Any person purchasing, receiving, or otherwise acquiring any product, compound, mixture, or preparation containing any detectable quantity of pseudoephedrine, its salts or optical isomers, or salts of optical isomers shall produce photo identification showing the date of birth of the person and shall sign a written log or receipt showing the date of the transaction, name of the person, and the amount of the product, compound, mixture, or preparation purchased, received, or acquired. No person shall purchase, receive, or acquire more than 9 grams of any product, compound, mixture, or preparation within any 30 day period; provided, however, that this limitation shall not apply to any such product, compound, mixture, or preparation dispensed pursuant to a valid prescription.
(3) Such transaction logs or receipts shall be maintained by the pharmacy in the same manner and for the same period of time as for controlled substances."
SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
