BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Part 8 of Article 6 of Chapter 2 of Title 20 of the Official Code of
Georgia Annotated, relating to the State Board of Education under the "Quality
Basic Education Act," so as to require the State Board of Education to annually
notify secondary students and their parents of their right under federal law to
opt out of providing student information for purposes of military recruitment;
to provide for a short title; to provide legislative findings; to provide for
related matters; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
This
Act shall be known and may be cited as the
"Parentś
Right to Know Act."
SECTION
2.
The
General Assembly finds:
(1)
The U.S. Armed Forces are made up entirely of volunteers;
(2)
In order to recruit new volunteers, the military relies heavily on access to
student information through our schools;
(3)
Federal law allows the release of certain student information for purposes of
military recruitment under certain conditions;
(4)
Federal law also requires that parents and students 18 years of age or older be
given the opportunity to withhold student information from military
recruiters;
(5)
Federal law requires local that school systems provide notice to parents and
students of their right to opt out; and
(6)
Parents do not always receive such notice.
SECTION
3.
Part
8 of Article 6 of Chapter 2 of Title 20 of the Official Code of Georgia
Annotated, relating to the State Board of Education under the "Quality Basic
Education Act," is amended by inserting a new Code section to read as
follows:
"20-2-245.
The
State Board of Education shall provide annual notice to all public secondary
school students and their parents or legal guardians of their right under
Section 9528 of the federal No Child Left Behind Act of 2001 (P. L. 107-110) to
request that the
student́s
name, address, and telephone listing not be released for purposes of military
recruitment without prior written
consent."
SECTION
4.
All
laws and parts of laws in conflict with this Act are repealed.
