BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 46-5-25 of the Official Code of Georgia Annotated, relating
to transmission of unsolicited commercial facsimile messages, so as to change
certain provisions regarding disconnection of telephone service of certain
violators; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 46-5-25 of the Official Code of Georgia Annotated, relating to
transmission of unsolicited commercial facsimile messages, is amended by
striking subsection (e) and inserting in its place a new subsection (e) to read
as follows:
"(e)
The commission is charged with the responsibility of civil enforcement of this
Code section and the commission shall require local exchange companies to file
with the commission appropriate tariff revisions to implement this subsection.
Any person who violates the provisions of this Code section shall be subject to
immediate
disconnection of telephone service
for a period
of six months
if the
violation does not cease within ten days from the date of notification to such
person by the local exchange company
upon
presentation of the unsolicited facsimile message by the person who received
such unsolicited facsimile message; and
the tariff revisions filed by local exchange companies shall provide for
the giving
of such notification by local exchange companies and
for such disconnection of
service."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
