BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 31 of Title 36 of the Official Code of Georgia Annotated, relating
to incorporation of municipal corporations, so as to require for referendum
approval of new incorporations; to provide for related matters; to repeal
conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
31 of Title 36 of the Official Code of Georgia Annotated, relating to
incorporation of municipal corporations, is amended by adding a new Code
Section 36-31-6.1 to read as follows:
"36-31-6.1.
(a)
Any local Act chartering a new municipal corporation must include a provision
that it will become effective only if it is approved by the voters of the
unincorporated areas of the county in which the new municipal corporation will
be located at a special election to be held for that purpose. In the case of a
new municipal corporation to be located in more than one county, the concurrent
approval of the voters of the unincorporated areas of each affected county shall
be required.
(b)
In addition to the voter approval required under subsection (a) of this Code
section, such a local Act may, but shall not be required to, provide that it
must receive concurrent approval by the voters of the territory which will be
incorporated as the new municipal
corporation."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
