BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act to re-create and reincorporate the City of Woodstock, approved
April 17, 1975 (Ga. L. 1975, p. 4160), as amended, so as to provide
that it shall require the affirmative votes of five councilmembers to approve
the exercise of the power of eminent domain in the city limits; to provide for a
quorum; to provide for related matters; to repeal conflicting laws; and for
other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act to re-create and reincorporate the City of Woodstock, approved April 17,
1975 (Ga. L. 1975, p. 4160), as amended, is amended by striking
Section 2.33 and inserting in lieu thereof a new Section 2.33 to read as
follows:
"SECTION
2.33.
Quorum; voting.
Quorum; voting.
Four
elected officials shall constitute a quorum and shall be authorized to transact
business of the council. Voting on the adoption of ordinances shall be taken by
voice vote and the ayes and nays shall be recorded in the journal but any
members of the council shall have the right to request a roll call vote. The
affirmative vote of three councilmembers shall be required for the adoption of
any ordinance, resolution, or motion except as otherwise provided in this
charter; provided, however, that the affirmative vote of five councilmembers
shall be required to exercise the power of eminent domain within the corporate
boundaries of the city. In the event of a tie vote on any question, the mayor
shall cast a vote to break the
tie."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
