A BILL TO BE ENTITLED
AN ACT

To amend Article 4 of Chapter 6 of Title 32 of the Official Code of Georgia Annotated, relating to limited-access roads, so as to provide authority for the Department of Transportation to lease certain state property for the purpose of commercial development; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

Article 4 of Chapter 6 of Title 32 of the Official Code of Georgia Annotated, relating to limited-access roads, is amended by adding a new Code section immediately following Code Section 32-6-119 to read as follows:
"32-6-120.
The department is authorized to lease property on or adjacent to property where public rest areas or welcome centers are located for development as commercial enterprises or activities. Prior to entering into any negotiations for the lease of such property, the department shall advertise its intent to negotiate the lease of such property at least once a week for four consecutive weeks in one or more newspapers of general circulation in the county or counties where the leased property is located and also in the legal organ of Fulton County. The department shall determine the best primary use for any property it intends to lease which purpose shall be clearly set forth in any advertisement or request for offers to lease. Any person, firm, or corporation leasing such property shall reimburse the department for all costs, including administrative costs, incurred by the department in connection with the negotiation of said lease. When two or more offers are received by the department for a lease of property, the highest responsible offer shall be accepted by the department; provided, however, that the department may also elect to withdraw its request for offers and is under no obligation to accept any such offer if the department determines, in its discretion, that no offer was presented which is acceptable or in the best interest of the department or state."
SECTION 2.
This Act shall become effective on July 1, 2006.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
